1. Acceptance of Terms By placing an order, making a deposit, or completing a purchase with Hudson Games, LLC (“Hudson Games,” “we,” “us,” or “our”), you (“Buyer” or “you”) agree to be bound by these Purchase Agreement and Sales Terms. These terms constitute the entire agreement between you and Hudson Games regarding the sale of products and supersede all prior understandings.
These terms apply to all purchases, including pinball machines, shuffleboard tables, foosball tables, billiards, table tennis, and other premium game room products.
2. All Sales Final • No Refunds or Cancellations All sales are final. Once your order is placed and accepted, it cannot be canceled, modified, or refunded except as expressly provided in Section 5 (Limited Warranty and Defects) below.
Products are sold on an “AS IS” basis except for the manufacturer’s limited warranty. Because these are high-value, curated, often limited-edition items that require significant handling, customization, and white-glove delivery, we do not accept returns for change of mind, buyer’s remorse, or other discretionary reasons.
3. Payment and Deposits Full payment or a non-refundable deposit (as specified at time of order) is required to secure your purchase. Deposits are non-refundable and will be applied toward the purchase price. Remaining balance is due prior to shipment or delivery.
We accept credit cards, but all payments are subject to our fraud prevention and verification procedures. You authorize us to charge the provided payment method for the full amount plus applicable taxes, shipping, and fees.
4. Delivery, Acceptance, and Inspection All shipments use white-glove delivery service with adult signature required. Delivery includes in-home placement in the room of your choice (where accessible) and basic setup as per manufacturer guidelines.
Critical: You (or your authorized representative) must be present at delivery and must thoroughly inspect the product immediately upon receipt for any visible damage, missing parts, or non-conformance with the order.
By signing for delivery or accepting the product, you acknowledge that the item was received in good condition and matches the description. Any claims for damage, shortage, or non-conformance must be reported to us in writing with photos and supporting evidence within 24 hours of delivery. Failure to do so constitutes acceptance and waives any later claims.
Risk of loss transfers to you upon delivery to the carrier or upon in-home placement, whichever occurs first.
5. Limited Warranty and Defects Products carry only the manufacturer’s limited warranty (e.g., Stern Pinball or Jersey Jack Pinball warranty). Hudson Games does not provide additional warranties.
For genuine manufacturing defects reported in accordance with the manufacturer’s policy and our inspection requirements, we will assist with warranty claims. We do not offer refunds or replacements for cosmetic issues, normal wear, or issues arising after acceptance.
No returns are accepted for any reason other than unresolved manufacturer defects properly processed through the warranty channel.
6. Chargebacks and Disputes Any attempt to initiate a chargeback, reversal, or dispute with your payment provider for reasons other than unauthorized use of your card (where the product was not delivered or was materially defective as determined under these terms) will be vigorously defended.
You agree that if a chargeback is filed improperly, you will reimburse Hudson Games for the full amount of the chargeback, any associated fees, collection costs, and reasonable attorney’s fees. We reserve the right to report such activity and may refuse future business with you.
Clear records of your acknowledgment of these terms, order confirmation, delivery signature, and inspection will be provided in any dispute proceeding.
7. Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Florida. You consent to the personal jurisdiction of such courts.
In any legal action or arbitration arising from this Agreement, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs.
BUYER ACKNOWLEDGMENT
I have read, understood, and agree to be bound by the above Purchase Agreement and Sales Terms, including the “All Sales Final” policy, delivery inspection requirements, and dispute provisions. I understand that this is a binding contract for a high-value purchase and that refunds or cancellations are not available except as expressly stated.
